9.1 Debt Mediation enquiries and administrative matters must be directed to the dedicated Debt Mediation contact details provided on the Contact page. RP Attorneys’ general legal practice telephone number, WhatsApp and email address are not used for Debt Mediation administration or support.

Debt mediation is not a regulated financial service and should not be confused with debt review under the National Credit Act 34 of 2005. Consumers considering entering into a debt mediation arrangement are responsible for satisfying themselves as to the nature, terms, costs and consequences of the service and are encouraged to obtain independent professional advice before doing so.

9.2 Where RP Attorneys is appointed in connection with a debt mediation arrangement, its role is limited to the receipt of consumer funds into trust and the distribution of those funds pursuant to instructions received from the relevant debt mediator, in accordance with the applicable agreement concluded between the consumer, debt mediator and RP Attorneys.

9.3 RP Attorneys does not control and, to the extent permitted by law, accepts no responsibility for the advice, representations, services, acts or omissions of an independent debt mediator. Any complaint, dispute or query concerning the debt mediation service, the mediator’s conduct, the terms of the debt mediation arrangement or advice provided by the mediator must be directed to the relevant debt mediator.

9.4 Where a deduction is processed pursuant to a valid DebiCheck mandate authorised by the consumer, RP Attorneys accepts no responsibility, to the extent permitted by law, merely by reason of its receipt or administration of funds collected pursuant to that mandate. Any dispute concerning the authority for, amount of, or basis upon which a deduction was initiated should in the first instance be directed to the relevant debt mediator.

9.5 By voluntarily entering into a debt mediation agreement, the consumer represents that the decision to participate has been made voluntarily and after having had the opportunity to obtain independent professional advice. The conclusion of such an agreement should not be understood as arising from advice or a recommendation by RP Attorneys.

9.6 RP Attorneys is not involved in debt review, including an application for debt review, the administration of the debt-review process, the restructuring of obligations under debt review, or the termination of or removal of a debt-review status. A consumer who is under debt review, or who discovers that they are recorded as being under debt review while participating in a debt mediation arrangement, must immediately contact the appropriate debt-review service provider or other relevant debt-review contact channel. Debt-review enquiries must not be directed to RP Attorneys as debt mediation enquiries.

9.7 Debt Mediation enquiries and administrative matters falling within RP Attorneys’ limited role must be directed to the dedicated Debt Mediation contact details provided on the Contact page. RP Attorneys’ general legal-practice telephone number, WhatsApp and email address are not used for Debt Mediation administration or support.
